White House Asks Supreme Court to Fast-Track Ruling on Transgender Military Ban - Miranda Farrar

Many people know of Trump's proposal to ban all transgender military members, but recently, the Department of Justice has asked the White House to fast-track this ruling with a new proposal, which would ban all who have undergone transitioning or who require it. In addition, those who haven't experienced gender dysphoria would be forced to serve as their biological sex. To fast-track the lower courts, the issue must be crucial to the public, and it must require an immediate court decision. Solicitor General Noel J. Francisco, the one who made the petition, believes that this issue meets the requirements. A study in 2016 concluded that the cost of transition-related healthcare would be relatively low, and in militaries with transgender individuals, there weren't any problems with unity or readiness. Therefore, groups such as the Transgender Rights Project believe that the Trump administration is just pushing to establish discriminatory policies.

This article immediately raises some questions. If transition-related healthcare isn't too costly, why was the ban on transgender individuals proposed in the first place? Furthermore, why must this issue bypass all of the lower courts? As this issue isn't a problem financially, it is just a way to discriminate against transgender people. In addition, this ban doesn't make sense to me. Why are policies being put into place to keep people from serving their country? It seems like that would just inconvenience the government. In the Civil War, some women, unable to be on the front lines, dressed up as men so they could fight. All people should be able to serve their country if they feel it is their duty.

  1. This ban makes me so infuriated on so many different levels. There is definitely a lot more into the reasoning behind this than just the claim that it's too costly to treat transgender individuals. Just as you said, if they feel as if it is their duty to serve, why can't Trump's administration let them?
