Former Saturday Night Live comedian Tracy Morgan's lawsuit towards Walmart claims that there was careless and negligent in the operation of the vehicle. Morgan and fellow friends were hit by a Walmart 18 wheeler. This accident killed three others in the limo with Morgan while hospitalizing him. Walmart was not aware that the drivers of the truck had been operating on the road for more than 24 hours, which causes road fatigue. This caused the driver to be less oriented with what was going on around him, preventing the driver from being aware that he was speeding over 20 miles per hour over the speed limit when he collided with Morgan's limo. Walmart claims that the accident was made so horrendous because none of the passengers of the limo were wearing seat belts. In their response to Morgan's lawsuit, they say that the whole incident would have been lessened if they had taken advantage of the safety devices around them. It was also stated that the man who caused the crash was not and in no way affiliated with the Walmart franchise. There has not been a victim appointed yet, but Tracy's 28 page response complaint over the whole situation stirs Walmart to push for and open trial by jury. There is no set court date at this point in time.
We see stars as untouchable and almost omnipotent to all everyday mishappeneings. When there is a tragedy among those we look up to or constantly view on television, it is almost surreal to hear about what has happened. I see it as there are two faults in this case and either cannot be dismissed. Morgan and his friends suffered the greatest damages but were also not abiding by the laws of the road to keep themselves safe. However, there is no dismissing the neglect of the driver by the company for lack of rest and awareness of his own surroundings. I'm interested to keep up with where this case goes from here and how the two opposing sides state their cases in court.

Yea people are not aware in the streets. It makes me feel unsafe around other drivers.
ReplyDeleteI dont see a reason to sue WalMart for this freak accident. Ppl sue WalMart when they're poor as a cheap way to get money.. Last time I checked he was famous... He shouldn't need the money
