Although previously thought to be covered under section 215 of the Patriot Act, the practice of the NSA collecting phone metadata in bulk seems to be a misinterpretation on the NSA's part. The 2nd US Circuit Court of Appeals has just recently brought this to the public's attention with the impending revision of the Patriot Act as a whole. This ruling is an unforeseen result of the lawsuit against the Office of the Director of National Intelligence from the American Civil Liberties Union. Revision of the Patriot Act in June of this year will allow congress to either revise the act to encompass this practice or to ban it.
The leaked information by Edward Snowden about the government spying on our personal lives angered people enough to file a lawsuit against the entire operation on the basis of the American right to privacy. This declaration that the practice does seem to be unlawful will be a victory to Americans who fear that their texts or phone calls will incriminate them. So long as congress actually does the right thing.
