Synopsis: The state attorney of the 9th Judicial Circuit of Florida is suing Governor Rick Scott on his decision to reassign 23 of her first degree murder cases to other prosecutors. His reasoning for this action is because attorney Aramis Ayala refuses to pursue the death penalty on these cases. Ayala is now suing saying Scott has violated her constitutional rights.
Analysis: I myself am not opposed to death penalty. I believe there are some people who don't deserve to live. But there are others that don't think that, and I respect that. Governor Scott needs to do that as well. Ayala is an elected official who was chosen by the people, just like the governor. He needs to let her do her job. He shouldn't have the right to determine how a case is treated based on his personal beliefs.
Synthesis: This relates the the court decision of Witherspoon v. Illinois, which said that a potential juror's feelings on the death penalty cannot disqualify them from the jury selection process. Whether you are a juror, a governor, or a prosecutor, members of the court should do their jobs fairly without letting their personal bias getting in the way.
I love your synthesis! I definitely think that this case is wrong and she should have the right to transfer her cases because of her beliefs.
ReplyDeleteI do not agree with the death penalty at all. I think that a person should endure severe punishment on Earth and suffer eternally when they die as opposed to escaping persecution via an electric chair or drugs to simply end their earthly punishment.
