Ortiz, 35, was indicted on one count of capital murder, aggravated assault with a deadly weapon, unlawful restraint and evading arrest, the district attorney's office said in a statement. The grand jury upped the charge against Ortiz with Capital Murder. They upgraded it because, he knowingly caused the death.
This might be controversial, however my opinion is that I wouldn't say that he should get his life taken away but definitely sentenced to life for his crimes in prison.
