Marissa Rubio: 16 states sue the Trump administration over national emergency declaration

States like California, New York, and Michigan are suing Trump's decision to declare a national state of emergency to get border wall funding. Congress has constitutional authority over funding and the suits accuse Trump's act of being unconstitutional. Trump plans the use of a national emergency to get funding from counternarcotics and military construction. Congress denied funds so this is the first time in history that there has been this extent of expansion of executive power.

Though the elastic clause in the constitution calls for necessary and proper powers. In this case it is not necessary and proper to use a national state of emergency to fund a boarder wall that may or may not solve immigration issues. Undermining another branch of government creates a dangerous imbalance in powers.
