McKenzie Hartmann - Repealed 30 day sentence for rapist - 4 th Period

This article explores the recent actions of Montana prosecutors appealing a recent ruling that sentenced a rapist to only 31 days behind bars.  The predator, Stacey Dean Rambold a former high school teacher, plead guilty to the rape of his fourteen year old victim, Cherise Morales, who killed herself in 2010.  Despite his guilty plea and lewd past, he was also charged with the three other counts of sexual intercourse without consent, the judge found that a month's jail time was reasonable punishment.  Rambold's justification for his crime is that she "seemed older than her chronological age."  Additionally,  the judge made some incredibly insensitive and demoralizing to the victim and even women in general.  For what it's worth, the judge recanted his offensive statements and baseless sentence attempting to make amends for his poor judgement.  Prosecutors adamantly believe that the minimum sentencing for a case like this is warranted and ten years would be appropriate.  They have filed an appeal with the state's supreme court, but that is no indication of when or how the issue will be resolved.  

First of all, a month's prison time is in no way adequate punishment rape, especially one involving a young, innocent, impressionable girl.  I mean there are cases in which the adults in these inappropriate student teacher relationships go away for years, and that is when it's consensual. This is rape, a rape that led to the suicide of the victim, which should increase the severity of the punishment.  Also, the fact that she was not his only victim solidifies his role as a  predator.  As for his excuse that she appeared older, that is completely unbelievable considering she was his student, not some random person he met on the street, he knew full well what he was doing.  As for the judge, he should be charged with obstruction of justice at the very least.  You can hack a computer and get a 20 year sentence, yet he felt that 31 days was appropriate for a rapist whose crime led to the death of an underage girl.  It is ridiculous!  Furthermore, his callous remarks about the victims age and lack of control demonstrates a clear lack of control and plain ignorant stupidity on his part.  He additionally had to apologize to women as a whole for debasing and scorning them.  His blatant insensitivity and terrible judgement indicate that he is not fit to dictate sentencing or even be in a courtroom.

  1. I feel as though, even if states have some variations on punishments, that they should not be so contrasting. It seems rather ridiculous that such a small price had to be paid for such a severe crime.
