Last Wednesday, a federal judge named David Ezra blocked the Texas law which would require miscarriages and aborted fetuses to be buried properly. The judge stated that it was unconstitutional, noting that it would block current laws in place by the Supreme Court allowing abortions, and that with the law, which would add nothing to female reproductive rights, it would cause difficulty for those seeking abortions.
Had the fetal burial law been enacted, it would have come into conflict with the current laws in place, and would have thrown health care for women into disorder. Ezra is temporarily blocking the law, anticipating that a new Supreme Court could overturn the Roe v. Wade decision that legalized abortion in the United States.
This entire debate is reminiscent of the debate surrounding prohibition and the ammendments made to the constitution then.
